About this policy

Agostini Property Buyers & Advisory ("Agostini", "I", "me" or "my") is a Sydney buyers agency and vendor advocacy business run by James Agostini. I respect your privacy and handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

This policy explains what personal information I collect, why I collect it, how I use and protect it, and how you can access or correct it or make a complaint.

What is personal information?

Personal information is information or an opinion about you that identifies you, or from which you are reasonably identifiable. Examples include your name, phone number, email address and details about a property you want to buy or sell.

What personal information I collect

If you make an enquiry, subscribe to a newsletter or request a guide, I usually collect your name, email address, mobile number and the details you choose to share, such as suburbs, budget, timing and the type of property you are looking for.

If you engage me to buy or sell a property, I may also collect information needed to act for you, such as your address, identification, finance pre approval details, solicitor and broker contacts, property and contract details, and payment details for my invoice.

I do not ask for sensitive information (such as health or religious information) and ask that you do not send it to me.

How I collect it

Most information comes directly from you: through the forms on this website, by email, by phone, in person, or when you sign an agreement with me.

I may also receive information from others with your knowledge, such as a person who refers you, your solicitor or mortgage broker, selling agents, or publicly available sources such as property sales records.

Why I collect it and how I use it

I use your personal information to:

  • respond to your enquiry and provide the services you ask for
  • search for, assess, negotiate and bid on property on your behalf, or advise you on a sale
  • send you my Sydney Auction Market Update, market wraps, guides and property opportunities you have asked to receive
  • manage my business, keep records and send invoices
  • comply with my legal obligations, including real estate licensing and anti money laundering laws where they apply
  • improve this website and my services

If you choose not to give me some information, I may not be able to respond to your enquiry or act for you properly.

Newsletters and direct marketing

With your consent, I may send you newsletters, market updates and information about properties or services. Every email includes an unsubscribe link, in line with the Spam Act 2003 (Cth). You can also ask me to stop at any time by emailing or calling me, and I will update my records promptly.

I never sell or rent your personal information to anyone.

Who I share it with

I only share your information where it is needed to provide my services or where the law requires it. This may include:

  • selling agents, vendors, buyers and their representatives, when negotiating or bidding on your behalf
  • your solicitor or conveyancer, mortgage broker, building and pest inspectors and other professionals you ask me to work with
  • service providers who support my business, such as my website host, email and CRM software, and accounting software
  • government bodies, regulators or courts, when required by law

Storage overseas

Some of the software I use stores data in the cloud. This website is hosted by Netlify, which may store website form submissions on servers in the United States. My CRM and email newsletter platform (Zoho) may store data in Australia or overseas, including in the United States and India.

I choose reputable providers and take reasonable steps to ensure they handle your information consistently with Australian privacy law.

This website does not use advertising or tracking cookies. Like most websites, my hosting provider automatically records basic technical information such as your IP address, browser type and the pages you visit, to keep the site secure and working. The site also loads fonts from Google, which receives your IP address when the page loads.

If I add website analytics in future, I will update this policy. This website may link to other sites, including social media, which have their own privacy policies.

Dealing with me anonymously

You can browse this website and ask general questions without identifying yourself. To act for you on a purchase or sale, however, I need to know who you are.

How I protect your information

I take reasonable steps to protect your personal information from misuse, loss and unauthorised access, including secure, password protected accounts and limiting access to people who need it. When information is no longer needed, I securely delete or de identify it, unless I am required by law to keep it.

No method of sending information over the internet is completely secure, so please contact me by phone if you would prefer not to send something online.

You can ask for a copy of the personal information I hold about you, or ask me to correct it, by contacting me using the details below. I will respond within 30 days. There is no charge to make a request. If I cannot give you access, I will explain why in writing.
